Terms & Conditions

For all services provided by QSPro (Regan Turner, Quantity Surveyor)

 This Agreement becomes binding immediately on written, or electronic acceptance of the Quote and can be accepted by any person holding themselves out to be authorised by the Client to do so, including by the Client giving instructions to proceed with any works or acting in a manner which would suggest that the Client wishes to proceed with any works that have been communicated to the Client.
QSPro may vary this Agreement at any time by giving the Client 14 days’ written notice.

1. Services Provided
The services will be based on the agreed scope as outlined in the quote or accompanying documentation. Any additional services or variations will be subject to approval in writing and charged at the current hourly rate of $150 + GST.

2. Fees and Payment Terms

• All fees are quoted in NZD and exclude GST unless otherwise stated.

• Invoices will be issued at the completion of works, or monthly for ongoing engagements.

• Payment is due by the 20th of the month following the invoice date unless otherwise agreed.

• Overdue invoices may incur interest at 2% above the overdraft rate and recovery costs.
   

3. Construction Contracts Act
Invoices may constitute a payment claim under the Construction Contracts Act 2002. Clients have 5 working days to respond with a payment schedule if disputing any part of the invoice.

4. Client Obligations
Clients must:

• Provide timely access to project documentation, plans, and the site as required.

• Respond promptly to requests for information and decisions to avoid delays.
   

5. Project Timing
All services will be delivered within a reasonable time unless a specific timeframe is agreed in writing. Delays caused by external parties or client-side issues may result in revised timelines and costs.

6. Insurance and Liability
QSPro maintains current professional indemnity and public liability insurance. Liability is limited to direct losses up to a maximum of $250,000 or five times the fee charged, whichever is less. QSPro is not liable for delays, third-party errors, or consequential losses.

7. Intellectual Property
All documents produced by QSPro remain jointly owned by QSPro and the client. Use is limited to the intended project. Reuse for other purposes requires written permission.

8. Confidentiality
All project details and documentation will be treated as confidential unless disclosure is legally required or authorised by the client.

9. Termination
Either party may terminate the agreement with 20 business days’ notice if the other materially breaches the agreement. Fees for completed work to the date of termination will remain payable.

10. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through negotiation or mediation in good faith. If unresolved, the matter may be referred to arbitration under the Arbitration Act 1996.

By accepting this quote/invoice or paying the associated invoice, you acknowledge acceptance of these Terms and Conditions.
